There are a number of different stipulations included in the Hawaii Lawyers’ Rules of Professional Conduct, which are considered some of the most stringent in the country. An outline of Hawaii’s rules is as follows:
- According to Rule 7.1., Communications Concerning a Lawyer’s Services, a lawyer is not permitted to make any false or misleading communications in regards to the individual or his or her services. - Rule 7.2 states that in Hawaii, a lawyer is permitted to advertise his or her services in written, recorded, or electronic methods of communication, to include communications via public media. Additionally, a lawyer is not permitted to give anything of value to an individual who recommended his or her legal services, with certain exceptions.
- According to Rule 7.4, a lawyer must not state or imply that a lawyer is certified as a specialist in a particular field of law unless he or she has been certified as a specialist by an organization approved by an appropriate state authority. Terms that should be avoided include “expert,” “specialize,” or “specialist.”
